El derecho al paisaje: una prerrogativa humana y comunitaria, compleja y retadora

Abstract

Se hace un análisis del derecho al Paisaje como un derecho cultural frente a la expansión de los derechos humanos. Igualmente, se hace un examen de la naturaleza del Paisaje como derecho cultural a partir de criterios intrínsecos (autenticidad y significación) y criterios extrínsecos (uso y contribución al desarrollo) concluyendo que su protección fortalece su papel en el bienestar de la comunidad, requiriendo de instrumentos de planeación y regulación para garantizar su salvaguarda.

An analysis of the right to Landscape as a cultural right is made before the expansion of the human rights. Likewise, an examination of the nature of the Landscape as a cultural right is carried out on the basis of intrinsic criteria (authenticity and significance) and extrinsic criteria (use and contribution to development) concluding that its protection strengthens its role in the community welfare, requiring planning and regulation tools to ensure its safeguarding.
